This Policy applies across all platforms through which you interact with us, including but not limited to our website, GoHighLevel, Skool, Circle, Facebook, Instagram, YouTube, TikTok, LinkedIn, X (Twitter), Zoom, and Google Meet.

We collect only information that is reasonably necessary to operate our business and serve you effectively.

Directly Provided Information. We collect your name, email address, phone number, billing address, and any information you voluntarily submit through forms, purchases, registrations, intake questionnaires, or appointment bookings. When you book a call or consultation with us, we may collect details about your business, sales goals, challenges, and professional background to tailor our guidance.

Account Information. We collect login credentials and profile data associated with accounts created through platforms such as Skool or Slack. Authentication methods may include email/password, Google, or Facebook login.

Payment Information. We collect transaction data — including card type and purchase amounts — processed through Stripe and other processors, which may include Afterpay, Affirm, Klarna, Google Pay, and Apple Pay. Full card numbers are never stored on our servers. All payment processing complies with PCI-DSS standards.

Behavioral and Engagement Data. We collect information about your interactions with our emails, SMS messages, websites, pages viewed, links clicked, content consumed, and program participation.

Device and Technical Data. We collect IP addresses, browser type, device identifiers, operating system, referring URLs, and session duration, collected via cookies and analytics tools.

AI-Assisted Interaction Data. Sales Mavericks LLC operates AI-powered diagnostic and coaching tools, including the Sales Team Revenue Leak Diagnostic and the Sales Challenge Analyzer. When you interact with these tools, your inputs and responses may be processed by third-party AI infrastructure, including OpenAI's API. No personally identifiable information submitted to these tools is used to train third-party AI models. By using these tools, you expressly consent to this processing.


3. How We Collect Information

We collect data through website forms, landing pages, and checkout pages; email and SMS interactions; appointment booking and intake systems; AI-powered diagnostic and assessment tools; analytics platforms including Google Analytics, Meta Pixel, TikTok Pixel, and YouTube/Google Retargeting; third-party integrations including GoHighLevel, Skool, Zapier, Make, Zoom, Google Meet, and Stan Store; and social media platforms you use to interact with us directly.


4. How We Use Your Information

We use your personal data for purposes grounded in legitimate business, contractual, or legal bases. This includes delivering access to and supporting your use of our programs, coaching services, digital products, software tools, and communities; managing user accounts, memberships, and both one-time and recurring subscription relationships; personalizing communications, content, and marketing based on your behavior, preferences, and engagement; processing payments and providing transaction records; operating our AI-powered tools and diagnostic instruments; conducting internal analytics to improve our products, services, and user experience; running retargeting campaigns and audience segmentation through advertising platforms; complying with applicable legal and regulatory obligations; investigating and preventing fraudulent, abusive, or unauthorized activity; and enforcing our Terms and Conditions and other legal agreements. We do not use your data for purposes materially incompatible with those described above without your prior consent.

6. SMS and Email Consent — A2P Compliance Disclosure

By providing your phone number on any of our forms, landing pages, checkout pages, or other opt-in points, you expressly provide prior express written consent (PEWC) — as required under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227 — to receive recurring automated and manually initiated promotional, transactional, and personalized text messages from Sales Mavericks LLC. This consent is specific to Sales Mavericks LLC only and is not transferable to any other company or marketing partner. Consent to receive SMS communications is not a condition of purchasing any product or service.

By providing your email address, you consent to receive recurring promotional, transactional, and personalized email communications, including offers, program updates, launch announcements, and follow-up sequences.

A2P 10DLC Registration.

All SMS communications sent by Sales Mavericks LLC are transmitted via Application-to-Person (A2P) messaging infrastructure using 10-digit long code (10DLC) numbers registered with The Campaign Registry (TCR) as required by U.S. carriers including AT&T, Verizon, and T-Mobile. Our brand and messaging campaigns are registered and verified through our SMS service provider, Twilio, in compliance with current carrier requirements. As of February 2025, unregistered A2P traffic is blocked entirely by all major U.S. carriers. Our registration ensures message deliverability and compliance with all applicable carrier guidelines and CTIA Messaging Principles and Best Practices.

Message Frequency and Rates.

Message frequency varies based on your engagement and program enrollment. Standard message and data rates may apply depending on your wireless carrier and plan.

Opt-Out and Revocation of Consent.

You may opt out of SMS communications at any time by replying STOP to any message from us. Upon receipt of a valid opt-out request, we will send one final confirmation message acknowledging your unsubscription and confirming that no further marketing messages will be sent. You may also reply HELP at any time to receive support information. We honor all reasonable methods of consent revocation in compliance with current FCC rules under the TCPA. Consent revocation for marketing messages does not affect transactional or service-related messages tied to an active purchase or membership unless you specifically request cessation of all communications in writing to [email protected]. We process all opt-out and revocation requests within ten (10) business days in accordance with applicable FCC guidance.

SMS Data — No Third-Party Sharing for Marketing.

Mobile phone numbers and SMS opt-in consent data collected by Sales Mavericks LLC are never sold, rented, or shared with third parties for their own marketing purposes. This data is shared only with subcontractors and service providers — specifically Twilio for SMS delivery and GoHighLevel for CRM and campaign management — under strict confidentiality obligations and solely to facilitate our communications with you. This disclosure is made in express compliance with A2P 10DLC carrier requirements and TCR guidelines.

State-Specific Notice.

If you are a resident of Texas, the Texas SB 140 (effective September 2025) expands "telephone solicitation" protections to include text messages and ties violations to the Texas Deceptive Trade Practices Act. If you are a resident of Virginia, Virginia SB 1339 (effective January 2026) requires that opt-out requests be honored for a period of ten (10) years. Sales Mavericks LLC complies with these and all applicable state-level SMS regulations. Regulatory Compliance.

Our SMS program is designed and operated in compliance with the Telephone Consumer Protection Act (TCPA); FCC rules under 47 C.F.R. § 64.1200, including all currently effective consent and revocation requirements; CTIA Messaging Principles and Best Practices; A2P 10DLC carrier requirements administered through The Campaign Registry (TCR); and all applicable state-level consumer protection statutes. We monitor ongoing regulatory developments — including pending FCC rulemaking — and update our practices accordingly to maintain compliance as the legal landscape evolves.

Data Retention.

Email and SMS subscriber data is retained for the duration of your active relationship with us plus three (3) years or more following your last interaction, or until you request deletion as described in Section 11 of this Policy.


7. Data Storage and Security

We store user data on secure, U.S.-based servers provided by vetted technology partners including Stripe, GoHighLevel, and Skool. These platforms maintain industry-standard encryption in transit and at rest, access controls, and continuous security monitoring. IMPORTANT SECURITY DISCLAIMER: No data transmission over the internet or electronic storage method can be guaranteed to be 100% secure. While we employ commercially reasonable safeguards, we cannot warrant the absolute security of your information. By submitting personal data to us, you acknowledge and accept this inherent risk. In the event of a data breach materially affecting your rights, we will notify affected users in accordance with applicable law.


8. Sharing of Information

We do not sell, rent, trade, or otherwise disclose your personal information to third parties for their own marketing purposes. We share data only as necessary to operate our business and deliver our services, and only with parties contractually bound to protect your data. We do not engage in data brokerage as defined under California law or any analogous statute. 9. AI Tools — Specific Disclosure

Sales Mavericks LLC develops and deploys AI-powered tools to help users identify sales performance gaps and improve results. These tools process user-submitted text inputs through third-party AI APIs, including OpenAI. By using any AI-powered tool on our platforms, you acknowledge that your inputs will be transmitted to and processed by third-party AI infrastructure; you confirm that any information you submit does not contain highly sensitive personal data such as Social Security numbers, financial account numbers, or protected health information unless expressly required and disclosed; and you agree that Sales Mavericks LLC is not liable for outputs generated by AI tools, which are provided for informational and educational purposes only and do not constitute professional advice of any kind.


10. International Users

If you are located in the European Union, United Kingdom, or another jurisdiction with applicable data protection laws, you have the right to access and receive a copy of your personal data; correct inaccurate or incomplete data; request erasure of your data subject to applicable legal retention obligations; restrict or object to certain processing; data portability where technically feasible; and lodge a complaint with your local supervisory authority. We process data under the following lawful bases: performance of a contract, legitimate business interests, and consent where required. International data transfers to the United States are conducted with appropriate safeguards including standard contractual clauses and data processing agreements as applicable.


11. California Consumer Privacy Rights (CCPA/CPRA)

California residents have the right to know what personal data we collect, use, and share; request deletion of personal information subject to legal exceptions; correct inaccurate personal information; opt out of the sale or sharing of personal data (we do not sell personal data); receive equal service and pricing regardless of exercising privacy rights; and limit the use and disclosure of sensitive personal information. THE CONTENT, PROGRAMS, COACHING, TRAINING MATERIALS, AI TOOLS, AND ANY OTHER INFORMATION PROVIDED BY SALES MAVERICKS LLC ARE FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE LEGAL, FINANCIAL, MEDICAL, PSYCHOLOGICAL, OR OTHER PROFESSIONAL ADVICE. RESULTS DESCRIBED IN OUR MARKETING MATERIALS, TESTIMONIALS, OR CASE STUDIES REPRESENT INDIVIDUAL OUTCOMES AND ARE NOT GUARANTEES. INDIVIDUAL RESULTS WILL VARY BASED ON EFFORT, EXPERIENCE, MARKET CONDITIONS, AND OTHER FACTORS OUTSIDE OUR CONTROL. BY ENGAGING WITH OUR SERVICES, YOU ACKNOWLEDGE THAT SALES MAVERICKS LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING SPECIFIC OUTCOMES.


14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SALES MAVERICKS LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, WEBSITE, OR AI TOOLS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF SALES MAVERICKS LLC TO YOU FOR ANY CLAIM EXCEED THE AMOUNT YOU PAID TO SALES MAVERICKS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UPON WHICH SUCH CLAIM IS BASED.


15. Dispute Resolution and Governing Law

This Privacy Policy shall be governed by the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute that cannot be resolved informally shall be submitted to binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST SALES MAVERICKS LLC. This arbitration clause does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction in Davidson County, Tennessee.
